Introduction
When a song is streamed, the recording money does not normally go to the performer first. It goes to whoever controls the master rights—the copyright in the specific sound recording being played. In many cases that is a record label, although it can also be an independent artist, a distributor account, or a company that has acquired the recording rights. The distinction matters because streaming platforms generally pay the master-rights holder, and the artist’s eventual share depends on the contract governing that recording. Ownership, licensing terms and recoupment rules often determine whether an artist receives most of the streaming income, a small percentage of it, or nothing yet at all. What the sound recording copyright covers
The master, or sound recording copyright, protects a particular recorded performance rather than the underlying song. A recording of a composition and the composition itself are separate assets with separate revenue streams. If several artists record the same song, each recording has its own master copyright even though the underlying composition remains the same. Control of the master usually belongs to one of three parties:
- A record label that financed, acquired or contractually owns the recording.
- An independent artist who funded and released the recording themselves.
- A company or investor that later purchased or licensed the master catalogue. Because streaming services license recordings from master-rights holders, the first recipient of most recording-side streaming revenue is the entity controlling those rights. The platform does not usually examine the artist’s private royalty agreement; it simply pays the recognised rights holder according to its licence arrangements. A useful way to think about the system is that streaming services pay for access to recordings, not directly for artistic labour. The contractual relationship between artist and label determines how the resulting money is divided after it reaches the master owner. How labels and distributors receive master royalties
Streaming platforms aggregate usage data and allocate recording royalties to the owners or controllers of the master recordings. For major-label releases, payments typically flow to the label. For self-released music, payments generally flow through a distributor and then to the artist or artist-owned company. Traditional record contracts often give labels ownership or long-term control of masters in exchange for advances, recording budgets, marketing investment and global distribution. In that arrangement, streaming income is first collected by the label and then accounted to the artist according to the royalty provisions in the contract. By contrast, an artist who owns their masters can receive recording royalties much more directly. Distributors generally deduct fees or commissions and pass the remainder to the rights holder rather than taking ownership of the recordings themselves. The practical consequence is that identical streaming numbers can produce radically different artist earnings. A self-releasing artist who owns the master may retain the majority of recording revenue, while a signed artist may receive only the royalty percentage negotiated in their contract. Why recoupment can delay artist cash
One of the most important but least visible features of master-rights economics is recoupment. Under many recording agreements, labels advance money to artists for recording, marketing, touring support or other career development costs. Those advances are usually recoverable from the artist’s royalty share. This means streaming revenue may be generated immediately, yet the artist may not receive cash payments for a long period. The label first applies the artist’s royalty share toward the outstanding balance of recoupable costs. Only after that balance is cleared does additional royalty income become payable to the artist. Some agreements also contain cross-collateralisation provisions, allowing certain advances or losses from one project to be recovered against income from another. This can extend the period before artists receive direct streaming income. The Jacobson Firm, P.C. Why master ownership has become a strategic asset
The growth of streaming has increased the long-term value of master recordings because successful tracks can generate revenue for many years. As a result, ownership of masters has become one of the most important negotiating points in modern music contracts. Artists who retain ownership typically gain:
- Greater participation in future streaming income.
- More control over licensing decisions.
- A valuable catalogue asset that can be sold, licensed or inherited. [Soundcharts]soundcharts.commusic royaltiesHow Music Royalties Work: 6 Types of Music Royalties8 Jan 2020 — A complete guide to music royalties: understand streaming payouts, perfo…
Labels, however, argue that master ownership reflects the financial risk they assume through advances, promotion, marketing, distribution networks and long-term investment in recordings. The resulting trade-off is central to modern recording agreements: artists may exchange ownership or control for funding and industry support. This is why discussions about streaming payouts often miss the crucial question. The key issue is not only how much money a platform pays for streams, but who owns the master recording that receives that payment in the first place. Ownership determines where the money arrives first, while the contract determines how much of it ultimately reaches the artist.
