Why outputs do not settle the training issue

A common misunderstanding is that if an AI-generated song does not contain obvious copies of existing recordings, then the training process must have been lawful.

The two questions are separate.

One issue concerns the output: does the generated song infringe copyright, violate publicity rights, or misappropriate an artist’s identity?

The other concerns the training process: did developers use copyrighted recordings without permission while building the model?

A model could produce outputs that avoid direct copyright infringement while still having been trained on copyrighted material without authorisation. Conversely, a licensed training dataset would not automatically justify producing unauthorised voice replicas of living performers.
